Terms of Service

These Terms of Service govern your access to and use of the Tabraj website, mobile applications (if any), wallet services, payment features, and any related services (collectively, the “Services”) provided by Tabraj.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.

1. Eligibility

You must be at least 18 years old to use Tabraj. By using the Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Services under applicable law

2. Account Registration

To access certain features (including the wallet), you must create an account. You agree to:

• Provide accurate, current and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use or security breach
• Accept full responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information, are used for fraudulent activity, or violate these Terms.

3. Tabraj Wallet and Financial Services

3.1 Wallet Usage The Tabraj Wallet allows you to store funds, send and receive money from other Tabraj users, make payments for services, and withdraw funds to verified bank accounts or mobile money wallets.

3.2 Deposits and Withdrawals

• Deposits and withdrawals are subject to verification, limits, fees and processing times published on the platform
• You must only use payment methods that belong to you
• We may require identity verification (KYC) before allowing deposits, high-value transactions or withdrawals

3.3 Prohibited Activities You may not use the wallet or Services for:

• Illegal activities
• Money laundering, terrorist financing, fraud or scam
• Gambling (unless expressly permitted)
• Adult content payments (unless allowed in specific categories)
• Purchasing or selling prohibited goods/services
• Sending funds to yourself from multiple accounts to artificially inflate balances

3.4 Holds, Limits and Freezes We may place temporary holds, lower limits or freeze funds if we reasonably suspect fraud, violation of law, chargeback risk, or violation of these Terms.

4. User Conduct

You agree not to:

• Violate any applicable law or regulation
• Infringe intellectual property rights of others
• Post or transmit harmful code, viruses, malware
• Harass, threaten, impersonate or defraud other users
• Manipulate ratings, reviews or transaction records
• Use automated scripts, bots or scrapers without permission
• Attempt to gain unauthorized access to any part of the Services

5. Fees and Payment

• We may charge transaction fees, withdrawal fees, currency conversion fees or other service fees
• Current fees are displayed in the app/website and may be updated with notice
• By using the Services you agree to pay all applicable fees
• Refunds are generally not provided except in cases of clear error or as required by law

6. Intellectual Property

All content, trademarks, logos, designs, software and materials on Tabraj are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal and authorized business purposes only.

You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our written permission.

7. User Content

You retain ownership of content you post (messages, reviews, profile information, etc.), but by posting you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, display, reproduce, distribute and modify that content as necessary to operate, promote and improve the Services.

You are solely responsible for all content you submit.

8. Termination

We may suspend or terminate your account and access to the Services at any time, with or without cause, including for violation of these Terms, suspicious activity, or legal requirements.

Upon termination, your right to use the Services ends immediately. Remaining wallet balance will be handled in accordance with applicable law and our policies.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE FROM VIRUSES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABRAJ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.

Our total liability to you shall not exceed the total fees you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend and hold harmless Tabraj, its officers, directors, employees, agents and affiliates from any claim, demand, loss, liability, cost or expense (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your use of the Services, or your violation of any law or third-party rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the People’s Republic of Bangladesh. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.

13. Changes to the Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the website and/or sending notice through the platform or email. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
